New Brunswick Election

To all licensees of broadcasting undertakings serving the province of New Brunswick

1.     On 18 August 2 2006, a provincial election was announced in New Brunswick. The election will occur on 18 September 2006.

2.     The Commission reminds licensees that the “black-out” period for partisan political programs, including election campaign advertising, was removed from the Broadcasting Act in 1991. However, licensees should note that this pertains to the “black-out” period under the Broadcasting Act only and that applicable electoral laws may vary from one province or territory to another with respect to campaign advertising or other matters. Licensees are advised to seek appropriate advice relating to matters of provincial or territorial jurisdiction.

3.     Any question pertaining to applicable provincial legislation should be referred to New Brunswick’s Chief Electoral Officer.

Administrative renewal

1. The Commission renews the broadcasting licence for the national, Native radio network known as Aboriginal Voices Radio Network, from 1 September 2006 to 31 August 2007, subject to the terms and conditions in effect under the current licence.

2. This decision does not dispose of any substantive issue that may exist with respect to the renewal of this licence and interested parties will have an opportunity to comment at the appropriate time.

CFRM-FM Little Current – Technical change

1. The Commission approves the application by Manitoulin Radio Communication Inc. (Manitoulin Radio) to amend the broadcasting licence for the Type B community radio programming undertaking CFRM-FM Little Current, in order to change the frequency from 101.1 MHz (channel 266LP) to 100.7 MHz (channel 264A), and to change the authorized contours by increasing the effective radiated power (ERP) from 45 watts1 to 1,830 watts, by increasing the antenna height and by relocating the transmitter.

2. In support of its application, the licensee stated that the proposed changes would result in a better coverage to several surrounding communities on Manitoulin Island.

3. The Commission notes that the increase in power will result in a change of CFRM-FM Little Current’s status from a low-power unprotected service to a regular Class A FM service, and that the technical changes will result in a significant increase in the authorized contours of the station.

4. The Commission received two interventions in support of this application. Mr. Curtis Belcher, President of CJTK-FM Sudbury (licensee Eternacom Inc.), a station located about 45 kilometres from Little Current, supported the application by noting that local radio in Northern Ontario is a “scarce thing” and that CFRM-FM Little Current is a great asset to the Manitoulin Island area. Mr. Roland Panamick noted that the increase in power will allow the nearby municipality of M’Chigeeng to receive local radio service. There were no opposing interventions to this application.

5. The Commission notes that CFRM-FM Little Current is the only station which broadcasts locally from Manitoulin Island and that it is a member of the local Emergency Management Committee. As this station is equipped with generators, it is capable of providing emergency information during power outages and similar situations.

6. The Commission also notes that CFRM-FM Little Current provides an essential service to the Aboriginal population of Manitoulin Island, which represents approximately 35% of the total population of the island. Accordingly, this station has the overall support of Manitoulin Island’s Aboriginal population.

7. The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

8. The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, this authority will only be effective when the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

At a public hearing in Québec commencing 20 March 2006, the Commission considered 10 competitive applications for licences or licence amendments for commercial radio stations in the Québec area.

Denied - Radio Charlesbourg

12.
Radio Charlesbourg proposed to amend the licence of the French-language community radio station CIMI-FM Québec (Charlesbourg zone) by changing the frequency from 103.7 MHz (channel 279A1) to 106.9 MHz (channel 295B1). The licensee also proposed to change the station’s authorized contours to encompass the city of Québec. The applications by Radio Charlesbourg and Couleur Jazz were technically mutually exclusive given that both proposed to use 106.9 MHz.

The Commission will hold a public hearing commencing on 29 September 2006 at 9:30 a.m., at the Radisson Hotel Winnipeg Downtown, 288 Portage Avenue, Winnipeg, Manitoba. The deadline for filing of submissions is 5 September 2006.

The Commission has received complaints regarding Harmony Broadcasting Corporation, licensee of the instructional campus radio programming undertaking CJWV-FM Winnipeg, concerning its non-compliance with the station’s conditions of licence included in CJWV-FM Winnipeg- Licence renewal, Broadcasting Decision CRTC 2004-340 and elements of the Campus Radio Policy as set out in Public Notice CRTC 2000-12.
